Justice V.D. Agishi of the Federal High Court, Jos Division has refused to grant an injunction sought by the Plateau State PDP and the 16 sacked members of the Plateau House of Assembly who wanted to restrain the Speaker and members from Swearing-in the 16 APC lawmakers declared validly elected by the Court of Appeal.
In the motion exparte filed by the PDP and the sacked law makers at the High Court, they prayed the court to grant an exparte order restraining the Speaker of the Plateau State House of Assembly and its current 8 members from giving effect to the court of appeal judgement which sacked them from office.
But His Lordship Hon. Justice V.D. Agishi after hearing the application, said in view of the peculiarity of the case, it will not be right to grant their prayers.
He however ordered that the defendants should rather be put on notice for the mention of the case on 26th January 2024.
The court also refused to grant the prayers of the PDP and the sacked law makers asking the House of Assembly and the Speaker not to recognise the Certificates of Return issued to the 16 APC law makers by INEC.
The court ordered that all parties be served through substituted means with the originating processes and all other processes before the 26th January 2024 when the case comes up for mention.
